Each Defendant will take notice that on June 29, 2022, Plaintiff filed a Complaint for Foreclosure in the Carroll County Court of Common Pleas, P.O. Box 367, Carrollton, OH 44615, being 2022 CVE 30031 alleging that there is due to Plaintiff the sum of $63,191.56 plus interest at 2.0000% per annum from May 1, 2018, plus late charges, pre-payment penalties, title charges, court costs and expenses as applicable to the terms of the Promissory Note secured by a mortgage on the real property, which has a street address of 8889 Cumberland Rd., Leesville, OH 44695 and being permanent parcel number 25-0000043.00 1.

Plaintiff further alleged that by a reason of default in payment of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute. 

The Defendant(s) named above are required to answer and assert any interest in said property or be forever barred from asserting any interest therein, and to raise any defense to foreclosure of said mortgage, the marshalling of liens, the sale of said real property. Said Defendant(s) are required to file an Answer within twenty-eight days after last date of publication, which shall be published in The Carroll County Messenger once a week for three (3) consecutive weeks, or they might be denied a hearing in this case.

NOTICE OF FORFEITURE OF OIL AND GAS LEASE

Pursuant to Ohio Revised Code Section 5301.332

STATE OF OHIO 

COUNTY OF CARROLL 

SRO 22, LLC and Tusk Exploration II, LLC, being the owners of the oil, gas and minerals underlying 51.117 acres, more or less, located in Section 24, T16, R7, Rose Township, Carroll County, Ohio, further described as Surface Tax Parcel Number 31- 0001679-000, hereby gives notice of their intention to declare the following oil and gas lease forfeited pursuant to Ohio Revised Code Section 5301.332, for the following reasons: (1) the original lessee and their successors or assigns have failed and/or neglected to (i) comply with specifically described covenants provided for in the lease, and/or (ii) timely and properly extend the lease pursuant to the terms and provisions of such lease; and/or (2) the terms of the lease have expired and there are no producing or drilling oil and/or gas wells on the leased premises.

Oil and Gas Lease, from James D. Fishel and Ethel P. Fishel, his wife, dated August 14, 1964, and recorded on December 23, 1964, in Volume 38, Page 327 of the Lease Records of Carroll County, Ohio, with a primary term of ten (10) years, and covering 76.00 acres, more or less, out of Section 24, Rose Township, Carroll County, Ohio. Based on the Public Records of Carroll County, Ohio, said Oil and Gas Lease is now owned by Petrox, Inc., G & O Resources, Ltd., Stocker & Sitler Oil Co., Palm Petroleum Corporation, CGAS Properties, LP, R&S Operating, LLC, EOG Resources, Inc., EAP Ohio, LLC and Posse Energy, Ltd.

It is the intention of SRO 22, LLC and Tusk Exploration II, LLC, to file for record an Affidavit of Forfeiture with the Carroll County Recorder if the lessee does not file a release of record of the lease within thirty (30) days from the date of receipt of this notice.
