Sexual assault affects both adults and children across the United States.
In Carroll County, Sheriff Dale Williams’ detective bureau investigated 22 cases involving sexual assault and abuse.
“The majority of those involved children,” Sheriff Williams noted, adding a county man was recently sentenced to 10 years in prison for pandering obscenity involving a minor and pandering sexually oriented material involving a minor. Once released from prison, he will be listed as a sex offender in the system.
The state of Ohio’s e-SORN (Electronic Sex Offender Registration and Notification) system lists 51 registered sex offenders living in Carroll County. The state uses a three-tier system to identify offenders.

When a person is convicted of a sex crime in Ohio and is required to register as a sex offender, they will be placed into one of three Tiers. Classification is based on the crime the person was convicted of or pleaded guilty to. Once a sex offender is placed into a Tier, he or she must follow the registration requirements of that specific Tier.
The e-SORN system was developed in response to the 1994 passage of Megan’s Law. Following the passage of Megan’s Law, The Jacob Wetterling Act and the Federal Crime Act were passed. These legal additions to existing law require all states to pass a sex offender registration and notification law. To date, all 50 states have a sex offender registration law.
The passage of Senate Bill 5 on July 31, 2003, brought new guidelines for classifying sexual offenders and strengthened the current e-SORN Laws. Namely, any person convicted of certain sex offense violations of the Ohio Revised Code or similar laws of another state may be determined by the court to be required to register as a sex offender. From January 1997, all convicted sex offenders have been, and continue to be, subject to the registration requirements of the law.

Three Tiers
Tier I: A Tier I sex offender must register once a year for a term of 15 years. Tier I offenses can include importuning, unlawful sexual conduct with a minor, non-consensual and offender less than four years older than victim; voyeurism; sexual imposition; pandering obscenity and other offenses.

Tier II: A Tier II sex offender must register every 180 days for a term of 25 years. Tier II offenses can include compelling prostitution; pandering obscenity involving a minor; pandering sexually oriented material involving a minor; gross sexual imposition victim under 13; abduction with sexual motivation. Any sexual offense that occurs after the offender has been classified as a Tier I offender. This includes an attempt, complicity or conspiracy to commit any of these offenses. Pre-AWA Habitual offenders unless re-classified after hearing.

Tier III: A Tier III sex offender must register every 90 days for life. Tier III offenses can include rape, sexual battery, aggravated murder or murder with sexual motivation, unlawful death or termination of pregnancy as a result of committing or attempting to commit a felony with sexual motivation; felonious assault with sexual motivation. Pre-AWA predators unless re-classified after hearing. Any sexual offense that occurs after the offender is classified as a Tier II or Tier III offender. This includes an attempt, complicity or conspiracy to commit any of these offenses.
Tier III sex offenders are subject to community notification. When a Tier III sex offender (a) initially registers with the e-SORN system or (b) relocates to a new address, any neighbors within a 1,250-foot radius will be notified. Neighbors to be notified include residential neighbors, schools, registered daycare providers and law enforcement agencies.


Sex offenders of any Tier or classification who are convicted of crimes committed after July 31, 2003, are prohibited from living within 1,000 feet of a school. Sex offenders of any Tier or classification who are convicted for crimes after July 1, 2007, are prohibited from living within 1,000 feet of a daycare center or preschool.
In addition to mandatory registration with the county at predetermined intervals, sex offenders registered in any Tier must also immediately alert the county Sheriff to any changes in: Residential address, place of employment, enrollment in a school or place of higher education, phone number, volunteer work, car or vehicle, email address and social media and other website access information.
While community notification is only required for Tier III sex offenders, all registered sex offenders in Ohio are included in a searchable sex offender registry database. The database includes the sex offender’s name, photograph, sex crime of which they were guilty or pleaded guilty and residential address.
